Protect Children and Oppose SB 1540
Originally, SB 1540 was a decent bill to fix a legitimate issue with mandatory reporting. As can happen in Salem, the Democrats in the Senate amended the bill to change the age of consent for adolescents from 14 years old to the young age of 12 years old. SB 1540 passed the Oregon Senate on a party line vote by the Democrats and now is awaiting a vote in the Oregon House.
Oregon’s age of consent is 18 years old, but there are exceptions for adolescents who are close in age. For example, 14 years old is the current age that an adolescent is able to consent to sexual activity with someone who is no more than 3 years older than them. SB 1540 lowers this consent age for adolescents down to 12 years old.
SB 1540 would eliminate mandatory reporters (such as teachers, coaches, social workers, abortion providers etc.) from being required to report a situation where they know a 12 year old has had sex with someone else, unless they know the other person involved was 15 or older.
What happens if a 12 year old goes in for an abortion? A pregnant 12 year old is often the sign of an abusive situation. Under SB 1540, the abortion provider would not be required to report the pregnancy as potential abuse without clear proof the other person involved was 15 or older.
This bill defies common sense and decency. We must protect our children from this bill and the legislators that seem to think it is okay for 12 year olds to be engaged in sexual activity.
